Beyond Hackathon by Eurobank Terms and Conditions

1. Eurobank Ergasias S.A. (the “Bank”) with General Commercial Registry No 000223001000 whose address is at 8 Othonos str. Attica, Greece, is running an innovation competition under the name “BEYOND HACKATHON” (hereinafter called the “Competition”) in collaboration with Found.ation M.P. with General Commercial Registry Νο 126688501000 whose address is at Evristheos 2 Peiraios 123, Attica, Greece and THE CUBE WORKSPACE M.I.K.E.  with General Commercial Registry Νο 126594401000 whose address is at Kleisovis 8, Attica Greece (hereinafter collectively with the Bank referred to as the “Organisers”) at the building bearing the Greek alphabet sign H, located in Ν. Ιonia, 8 Iolkou Street, P.C. 14234,Athens, Greece (the “Venue”). The aim of the Competition is to facilitate the rapid creation of innovative “FinTech” and banking related applications.

2. The Competition is open to teams of physical persons each of whom shall be at least 18 years old on the date of registration to the Competition as well as to all validly and newly (maximum five years old at the time of the registration to the Competition) formed/incorporated legal entities that have not declared or been declared in bankruptcy. It is explicitly stated that physical persons cannot participate in the Competition individually. Participants, either as a team or as a legal entity, may only submit one entry. It is explicitly stated that throughout these terms, with the exception of term 9, the term “participants”, refers to teams of individuals and also to individuals that form such teams, to legal entities and also to the individuals designated by the legal entity to take part in the Competition on their behalf.

3. Employees of the Organisers or of any of their subsidiary or related companies and employees of all third parties (including but not limited to Partners, Supporters, Media Partners and Enablers) associated with the Competition are not eligible to take part. Subsidiaries of the Organisers and of all third parties (including but not limited to Partners, Supporters, Media Partners and Enablers) associated with the Competition are not eligible to take part.

4. The Organisers reserve the right to require participants to prove that they are eligible. If any of the winners is found to be ineligible, the Organisers reserve the right to award the prize to another participant and to require the return of any prize already awarded.

5. If the participants participate as a team they agree that, in order for a team to be eligible to participate, all team members must be eligible. In addition, they agree that if the team is selected to receive prizes, the team is responsible for ensuring that the prizes will be appropriately distributed to each member of the team. The eligibility of a participant is tied to the eligibility of the team. If one member of a team is disqualified or found to be ineligible, the team as a whole may be disqualified, in the Organisers’ sole discretion If the participants participate as an entity, they agree that they shall designate the individuals who will act and take part on their behalf in the Competition and who will have the right to represent the entity for the purposes of the Competition throughout the Competition. In order for an entity to be eligible to participate all the individuals designated by it must also be eligible. If one of the aforementioned individuals is disqualified or found to be ineligible, the entity as a whole may be disqualified, in the Organisers’ sole discretion.

6. The Competition will operate on the website at the following URL address www.beyondhackathon.com (the "Website").

7. The Competition consists of two stages: Stage A, during which a first evaluation and grading of the participants takes place aiming at the shortlisting of only twenty participants, who will then proceed with/participate in Stage B the Competition and Stage B during which takes place the development of the applications by the qualified participants and the selection of the winners .In order to take part in the Competition, the participants must register online by 17:00 (Athens, Greece time) on the closing date of 15 June 2018. Participants that participate as a team agree that all team members must register online individually by the aforementioned deadline. Participants that participate as an entity agree that all individuals designated by them to act and take part on their behalf in the Competition and to represent the entity for the purposes of the Competition must register online individually by the aforementioned deadline stating clearly among others that they register on behalf of an entity as well as the corporate name of such entity.  Details of how to register can be found on the Website. It is explicitly stated that the Organisers may terminate the registration procedure at any time, in case, among others, they receive an excessive number of applications for registration.

8. Stage A (16 June 2018 – 18 June 2018): The Organisers will appoint a Pre-evaluation Panel consisted of minimum three (3) Members, where each of the Organisers will be represented by at least one (1) member. The members of the Panel shall have relevant expertise. The members of the Pre-evaluation Panel will not be able to be part of the Judging Panel that will evaluate the participations in Stage B of the Competition. The above-mentioned Pre-evaluation Panel will evaluate and award points to the participants according to the criteria mentioned below (see number 12). Said criteria will also apply to the second stage of the Competition. The final score will be determined by the average points of the criteria (No 12) rounded up to two decimals. Twenty participants that will receive the highest score will be able to continue to the second stage of the Competition. In case of any tie all the participants who received equal marks will be qualified for stage B.  The first stage will be concluded on the 18th of June 2018. All the participants will be informed via email sent to the registered email address on whether they are qualified for stage B. In such case they will also receive proofs of participation with a barcode that they will have to present in order to enter the Competition venue. The Organisers reserve the right to refuse entry, or remove and disqualify a participant from the Competition at their sole discretion at any time for any reason.

9. All costs, including without limitation all transport costs, accommodation and other related costs incurred by the participants (the term participants for the purposes solely of the present term refers to individuals taking part in the Competition as part of a team or on behalf of a legal entity) as a result of and/or pursuant to their participation in the Competition shall be solely borne by the participants. The Organisers shall not be under any obligation to reimburse the participants for any such costs and expenses incurred thereof. In the event that any of the Partners or/and Supporters or/and Enablers of the present Competition decide at their sole discretion to reimburse any or part of the aforementioned costs for some or all of the participants, these Partners or/and Supporters or/and Enablers shall be solely responsible for the reimbursement of such costs according to the specific terms and conditions that they themselves will define.

10. All intellectual property rights in the applications of a participant shall remain vested in the participant who owns them. Any third party intellectual property rights shall remain vested in the third party or third parties who own them. The Participants acknowledge that many applications shall be developed during this Competition and that such applications may be similar or identical in theme, idea, format or other respects to others developed in this Competition. The participants acknowledge and agree that the Organisers do not have now, nor shall they have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright or other intellectual property right in or to the participants’ application.

11. The participants represent and warrant that (i) the application is their original, work and is developed and for the first time presented by them during this Competition, (ii) the application does not violate or infringe the intellectual property, proprietary or other rights of any third party, (iii) third party intellectual property rights are clearly identified by the participants as well as the applicable terms of license and other details relating to use of same (iv) they possess and control all rights necessary to submit the application irrevocably and without restriction to the Organisers, and (v) that publication of the application via various media including web posting and social media, will not infringe on the rights of any third party.

12. Stage B (22 June 2018 – 24 June 2018) : One (1) first prize and one (1) second prize will be awarded. First and second prize winners will be the eligible participants (entities or teams) that receive the first and second highest scores for their applications, respectively, as determined by the judging panel consisting of at least five (5) people with relevant expertise selected by the Organisers in their sole discretion. Evaluation of the applications will be based on the following three (3) criteria:

  • The quality of the idea – 33%, (on a scale of 1-10)
  • Its implementation, level of innovation and originality of code – 33%, (on a scale of 1-10)
  • The execution, as well as the overall user experience – 34%, (on a scale of 1-10)

Final score is determined by the average of these three (3) criteria rounded up to two (2) decimals. In the event of a tie, the applications involved in the tie will be reviewed by an additional judge selected by the Organisers in their sole discretion who will serve as a tiebreaker and who will evaluate applications according to the criteria listed above.

13. The cash prizes to be awarded by the Bank are as follows:

  • 1st Prize: seven thousand Euros (€7,000.00)
  • 2nd Prize: three thousand Euros (€3,000.00)

14. The winners are personally responsible for any personal or incidental expenses incurred in claiming or using the prizes. The payment of prizes will be made without any deduction for or on account of any taxes or levies.

15. The prizes are as stated. There is no other alternative to the prize in whole or in part.

16. The winners of the Competition will be announced the latest by 23:00 pm on 24 June 2018 and will be notified by telephone or email to the telephone number or email address provided to the Organisers by the winners within 10 working days of the Competition in order to submit valid identification and valid banking details before receiving their cash prize. The cash prizes will be delivered to the winners via bank transfer within sixty (60) business days of the valid identification and valid banking details submission by the winners unless otherwise indicated by the Organisers.

17. The participants shall be responsible for ensuring that the contact details associated with their entries are up to date and accurate so they can be contacted during both Stages of the Competition. If the Organisers or their authorized agents are not able to contact the winners during the first stage of the Competition in order to inform them that they qualify for the second stage by the 20th of June 2018 alternative participants will be selected according to their score in order to fill the first 20 places as described above (see Term 8). In case the Organisers or their authorized agents are not able to contact the winners by the 10th of July 2018, namely twelve (12) working days after the first attempted notification, alternative winners may be chosen by the judges and the original winners' entitlement will lapse.

18. The Organisers have no obligation to use, invest in or buy the applications developed in this Competition or otherwise contract with the participants.

19. Except for any liability that cannot be excluded by law, the Organizers, (their subsidiary and related companies, together with their officers, directors, employees, agents and representatives exclude all liability (including negligence) for any personal injury or any loss or any damage (including loss of opportunity-profit) whether direct, indirect, special or consequential, arising in any way out of or in connection with the Competition, including, but not limited to:

  • any technical difficulties, technical error or equipment malfunction, hardware or software failures, lost, faulty or unavailable network connections (whether or not under the Organiser’s control);
  • any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference;
  • any entry, prize, claim or other correspondence that is late, lost, altered, damaged, incomplete, illegible or misdirected (whether or not after their receipt by the Organisers due to any reason beyond the reasonable control of the Organisers;
  • any variation in prize value to that stated in these Terms and Conditions;
  • any tax liability (other than the one stated in term 14) incurred by a winner or participant; or
  • use of a prize.

20. The Organisers and/or any third parties acting on their behalf (data processors) process participants’/ winners’ data as described in the Information on Personal Data document which is referred to the registration Form.

21. By registering for and participating in the Competition the participants:

  • agree to abide by these Terms and Conditions. Promotional material relating to the Competition, including all information on how to enter the Competition, also forms part of these Terms and Conditions.  In the event of any conflict between any terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions take precedence;
  • agree to release and hold the Organisers, their subsidiary and related companies, together with their respective employees, officers, directors, agents and representatives, and all third parties associated with the Competition (Including but not limited to Partners, Supporters, Media Partners, Enablers )harmless from any and all losses, damages, rights, claims and actions of any kind in connection with participating in the Competition, with the developed applications or resulting from the acceptance or use of any of the prizes;
  • agree that the decisions of the Pre-evaluation Panel as well as the Judging Panel selected by the Organisers are final and binding in relation to the selection of the participants for the second stage of the Competition as well as  any prizes that may be awarded;
  • agree to protect the Bank’s Confidential Information (including but not limited to the APIs) from unauthorized dissemination and use it solely for the purpose of participating in the Competition; The term Confidential Information means any and all information and material of a confidential or proprietary nature, in any form or medium, written or oral, concerning or relating to the Organisers and/or the Competition (whether prepared by the Organisers or otherwise, and irrespective of the form or means of communication and whether it is labeled or otherwise identified as confidential) that is furnished to the Participants in connection with their participation in the Competition.
  • agree not to use or promote offensive, obscene, libelous, defamatory, unlawfully threatening, or unlawfully harassing or (any) other illegal material in their entries and applications;
  • agree not to install any viruses, trojan horses, worms, time bombs, cancelbots, or other computer programming routines or malicious code that may damage, detrimentally interfere with, surreptitiously intercept, or expropriate any Bank’s system, data, or other information;
  • agree that their participation in the Competition will not breach any duty of confidentiality or contractual rights owed to any third party and that with their participation they do not violate any law, contract, or regulation;
  • agree to use the Bank’s systems and APIs solely for participation in the Competition , and not to sell, lease, rent, license, sublicense, distribute, repackage, assign or otherwise transfer the Bank’s APIs documentation or source code to any third party. The participants also agree that they are not authorized to permit any other person to use the Bank’s systems and APIs on a time sharing or any other basis. The Bank’s systems and APIs are provided with RESTRICTED RIGHTS, in terms of usage and distribution of documents, information and data outside of the scope of the Competition. The Bank retains ownership of all right, title and interest in and to the Bank’s systems and APIs and any other material or information provided or made available to the participants in order to participate in the Competition.
  • agree not to cause or permit the reverse engineering, modification, decryption, extraction, disassembly, or de-compilation of the Bank’s systems and APIs or otherwise attempt to discover the underlying ideas, algorithms, structure or organizational form of the API. The participants agree not to use the APIs in a manner that is unlawful or that harms the Bank and not to interfere with, modify, or disable any features, functionality, or security controls of the API, or attempt to defeat, avoid, bypass, remove, deactivate or otherwise circumvent any protection mechanisms for the API. The participants also agree not to copy the documentation (if any) accompanying the Bank’s systems and APIs, but use them solely for the purpose of facilitating the use of the Bank’s systems and APIs in accordance with, and subject to, the present Terms and Conditions. The participants also agree not to copy or allow others to copy the Bank’s systems and APIs or related documentation, or any portion thereof, for any other purpose. The participants agree not to remove any product identification, copyright notices, or other notices or proprietary restrictions from the Bank’s systems and APIs.
  • agree that they do not have any right, license power or authority to take any action, and will not take any action, directly or indirectly, that would create, or purport to create, obligations for the Bank with respect to the APIs.
  • agree that by the end of the Competition they  shall return all data and APIs received from the Bank in order to participate in the Competition.

22. The Organisers reserve the right to suspend, change or cancel the Competition at any time as they may determine in their sole discretion and do not accept any responsibility for any damage, loss or expense arising thereof.

23. The Organisers reserve the right in their sole discretion to amend these Τerms and Conditions at any time by posting an updated version on the Website www.beyondhackathon.com

24. These terms and conditions shall be governed by the laws of Greece. The courts of Athens shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Competition or these Terms and Conditions.

25. These terms and conditions have also been translated in Greek. The authentic version is the English one. In the event of any conflict between the English and the Greek version, the English version shall prevail.
